Winning a case at HRERA is one thing. Getting the builder to actually pay is another, and for many Gurugram buyers the money has never come.
The Gurugram district administration is now going after it. Deputy Commissioner Uttam Singh has started recovery proceedings against 71 builders and promoters who haven’t paid refunds, interest and penalties that HRERA ordered. The recovery certificates add up to ₹446 crore. Some of these cases have been pending for more than four years.
Under Section 40(1) of the RERA Act, 2016, the administration has ordered the defaulters’ bank accounts to be frozen. It has also started proceedings to attach their movable and immovable property.
“The money will be recovered from frozen bank accounts or attached properties,” Singh said. “If that fails, further steps under the Act would be taken, which may also lead to arrests.”
The largest amounts named in the report are:
• Ansal Housing / Ansal Construction Housing: ₹91 crore
• Raheja: ₹90 crore
• Vatika: ₹80 crore
• Parsvnath: ₹74 crore
• Ramprastha: ₹57 crore
• IREO: ₹24 crore
• ILD Millennium: ₹8.59 crore
Ansal Housing is a separate listed company from Ansal API, the developer of Celebrity Homes in Palam Vihar.
If you already hold an HRERA order that a builder hasn’t paid, this drive is your best chance in years of getting the money. Check that your case has a recovery certificate issued. If it doesn’t, ask your lawyer to apply for one so your claim is included.
If you’re buying now, this list is a reminder to check a developer’s record at HRERA before you pay a booking amount. Brochures and sample flats won’t show you this. Look at how many complaints it has, whether it paid past orders, and whether its earlier projects were delivered on time.
We check the HRERA record of every developer whose project we recommend, and we’re happy to share what we find with you.
